California passed a restructuring act in 1997, but it was a disaster as the market rules created many holes that were exploited by wholesale traders. This helped cause the energy crisis in 2000, which led to the suspension of full deregulation. Deregulaiton participants were allowed to continue in deregulation and were labeled “Direct Access Clients.” Direct Access clients represent about 5 percent of the total load in the state. If a participant wanted to return to a utility company, they were given the utility tariff rate and were not allowed to return to shop for a retailer. In 2010, Senate Bill 695 began to take effect as a small portion, another 5 percent of the market, has been allowed to apply and shop for a third-party supplier. This is a very limited part of the market and will happen in stages beginning now until 2014.
